Britain Bans Anime

This is not a joke.

Remember back when we were talking about a law floating around Japan that would ban any sort of underage girl in any sort of explicit situation? Well that law might be dead in Japan, but in the UK a law just like it was passed and is now in effect! Basically the “ Dangerous Cartoon” act, or the “ Coroners and Justice Act 2009” will make anyone owning a picture, movie, video game, etc. that has a character that looks like a child and in a sexual situation, can face up to 3 years of prison time. Which bans almost every hentai manga or anime, and can even make watching some mainstream shows completely illegal.

Who knows where they draw the line? The only thing that is saving this law is that it is so outrageous that there can be no possible way they can enforce it, without throwing many thousands of people into jail.

Press play, enjoy 3 years in prison

The Actual Wording of the Law

Here is the actual wording of the law, which clearly defines what it will impact:

@GWOtaku
 said:

" "Who knows where they draw the line? Even anime like Dragon Ball and My Neighbor Totoro are completely illegal in the UK."

This is flat out untrue.

I direct everyone's attention to chapter 62, in chapter 2 (http://www.opsi.gov.uk/acts/acts2009/ukpga_20090025_en_5#pt2-ch2), which was linked at the Backlash website cited here.

This area is where a "prohibited image of a child" is defined.

Fact: It says that a prohibited  image "is pornographic," **and** that it "falls withhin subsection (6)", **and** that it "is grossly offensive, disgusting or otherwise of an obscene character."

Fact: subsection 6 covers "an image which focuses solely or principally on a child's genitals or anal region" or one of several items detailed in section seven, all of which have to do with sexual acts involving children. The emphasis is mine. Note how this contradicts the claim that  "It does not matter if this image is an important part of the story, or have anything to do with “sex”, if the image is there, you broke the law." That is not true. Also notice how everything in section seven has to do with sex with children--it does NOT target simple nudity. So no, this couldn't be used to ban Dragon Ball.  Specifically, section seven singles out intercourse, oral sex, penetration, or masturbation that is involving a child or in the presence of a child, with the same going for intercourse or oral sex concerning children and animals.  Follow the link above and read all of it for yourself. This is not a slippery slope and it does not ban "mainstream" anime. "

Holy fucking shit...  I do live in the USA, so I can't feel what is actually feels like to have this in affect.  If there are any Britain users here on AV, I would like to here your thoughts.

Also, don't watch the video.  It has hot girl on girl action that will send you to prison.
metalsnakezeroon April 6, 2010 at 6:29 p.m.
Man, UK is fucked up. These laws aren't very flexibly with the content of most media and are limiting art ideas.
BTW nice pick with the Needless ed :D

Being arrested for watching dragonball? The british lawmakers must have not had their tea this morning.
GodLen staff on April 6, 2010 at 6:33 p.m.
The law also mentions that is isn't just children, but anyone under 18

Makes me think of that book "3 Felonies a Day"
sunfloweron April 6, 2010 at 6:37 p.m.
It's not just girls, but all people under 18.  So anyone in high school.  Which means half all BL is now banned as well.
GodLen staff on April 6, 2010 at 6:40 p.m.
@sunflower: yeah i totally forget about that, Its anyone, but even the law constantly uses the word female which is really weird.
Rokujoon April 6, 2010 at 6:42 p.m.
Living in England, we get this garbage all the time. They're also trying to pass a bill where they are allowed to monitor our Internet activity. God bless freedom.
Dreamon April 6, 2010 at 6:42 p.m.
And here I thought mainstream America was uptight enough about underage sexuality in anime.

Guess this would mean if I lived in the UK, my Elfen Lied collection would land me in the slammer (compliments of Nana, Mayu and a young Lucy).

EDIT (reads above): Great, so a good chunk of what I have in my collection would nail me to jail and be labeled a sexual offender in the UK.
FLStyleon April 6, 2010 at 6:46 p.m.
I'd love to say I'm surprised but this is probably only the beginning. I wouldn't be surprised to see all sorts of stupid media related laws passed by my country's government in the near future.
Theresonlyoneon April 6, 2010 at 6:46 p.m.
@JJOR64: This won't be enforced. We're having an election so the politicians are scrambling for votes they wouldn't dare do something that comes so close to censorship so close to polling day. As an anime fan this is fucking outrageous this bans every series i like; Elfen lied, gantz, mnemosyne and depending on the sensibilities of the person Death Note is illegal as well as sailor moon and the fucking ghibli movies... I will happily encourage my future children to watch them.

so they kiss at the end of ponyo so is that banned now...must be nice not having a bill of rights...
JDon April 6, 2010 at 6:52 p.m.
This is bad, but I wonder if it's as bad as the blog post assumes.  As to whether DBZ or Totoro counts, I guess what it comes down to is whether nudity is considered a sexual situation by default.
Nerxon April 6, 2010 at 6:55 p.m.
If that is the case then they can jail me to life and fuck you to the lawman. These laws are just getting too damn ridiculous nowadays, I hope that the anime fans over there find a loophole in the system and exploit it.
Netstrykeon April 6, 2010 at 7:01 p.m.
The UK Parliament has just murdered Anime in the UK.
I feel so bad for the anime fans in the UK right now.

A moment of silence for the Anime Industry (stores, cons, blogs, etc.)  in England., please

Don't they have a right to free speech?
